AGREEMENT BETWEEN THE GOVERNMENT OF THE PEOPLE'S  REPUBLIC OF BULGARIA AND THE GOVERNMENT OF THE UNITED STATES PEACE CORPS IN THE PEOPLE'S REPUBLIC OF BULGARIA


  The Government of the People's Republic of Bulgaria and the Government of the United States of America, hereinafter called the Parties, recognizing the importance of developing mutually advantageous relationships and cooperation between their nations, have agreed as follows:

ARTICLE I

  The Government of the United States will furnish such Peace Corps volunteers as may be requested by the Government of the People's Republic of Bulgaria and approved by the Government of the United States to perform mutually agreed tasks in the People's Republic of Bulgaria to be defined by the Parties in protocol (s) under Article VIII implementing this agreement. The volunteers will work under the immediate supervision of governmental and private organizations in the People's Republic of Bulgaria selected by mutual agreement of both Governments. The individuals to be received as volunteers will be mutually agreed upon by the Parties on the basis of conditions to be specified in a protocol. The Government of the United States will provide training to enable the volunteers to perform the agreed tasks in the most effective manner.

ARTICLE II

     The Government of the People's Republic of Bulgaria will treat the volunteers and their property equitably, will give them full aid and protection, including treatment no less favorable than that given generally to nationals of the United States residing in the People's Republic of Bulgaria. The People's Republic of Bulgaria will fully consult and cooperate with representatives of the Government of the United States on all matters concerning the volunteers. The Government of the People's Republic of Bulgaria will exempt the volunteers from all taxes on payments which they receive for their living costs and on income from sources outside the People's Republic of Bulgaria. The Government of the People's Republic of Bulgaria will also exempt the volunteers from all customs duties or other charges on personal property brought into the People's Republic of Bulgaria for their own use, provided that the property imported will not be sold in the People's Republic of Bulgaria, and from all other taxes (including immigration fees) except for storage, transportation, or similar charges. The volunteers will not be exempt from payment of license fees and taxes included in the prices of equipment, supplies and services purchased in the People's Republic of Bulgaria.

ARTICLE III

   The Government of the United States will provide the volunteers with such limited quantities of equipment and supplies as our two Governments may agree on as necessary to permit the volunteers to perform their tasks effectively. The Government of the People's Republic of Bulgaria will exempt from all taxes, customs duties and other charges all equipment and supplies imported into the People's Republic of Bulgaria or purchased by the Government of the United States or any contractor financed by it in the People's Republic of Bulgaria for use in Peace Corps programs. Articles imported or purchased pursuant to this provision will not be alienated within the People's Republic of Bulgaria, except to an individual or organization holding a similar exemption or by donation to an agency of the Government of the People's Republic of Bulgaria, or an organization supervising volunteers under this Agreement.

ARTICLE IV

   To enable the Government of the United States to meet its responsibilities under this Agreement, the Government of the People's Republic of Bulgaria will receive a representative of the United States Peace Corps and such staff of the representative, including personnel performing functions under contract with the Government of the United States, as are acceptable to the Government of thePeople's Republic of Bulgaria. 

    Except as otherwise agreed upon by the Parties, the representative, staff members, and contractors who are not nationals of the People's Republic of Bulgaria will be granted the same treatment as is accorded volunteers under this Agreement. The representative and staff members will also be accorded the same treatment as personnel of comparable rank in the United States Embassy except they will not have diplomatic or diplomatic immunity.

ARTICLE V

    The Government of the People's Republic of Bulgaria will exempt from investment and deposit requirements and currency controls all funds introduced into the People's Republic of Bulgaria for use by the Government of the United States or contractors financed by it in Peace Corps programs. Such funds shall be convertible into Bulgarian currency at an authorized agency in the People's Republic of Bulgaria at the highest rate that is lawful in the People's Republic of Bulgaria.

ARTICLE VI

     The Peace Corps representative, staff, contractors, and volunteers will respect and comply with national laws and regulations while in the People's Republic of Bulgaria.

ARTICLE VII

    The Government of the People's Republic of Bulgaria shall designate the appropriate government agencies, and the Government of the United States designates the Peace Corps to implement this Agreement, as executive agents.

ARTICLE VIII

  From time to time, appropriate representatives of our two Governments may make such arrangements with respect to Peace Corps volunteers and Peace Corps programs in the People's Republic of Bulgaria as are necessary or desirable for the purpose of carrying out this Agreement. Any changes to this Agreement will be made in written protocols by the two Governments in the form of amendments to this Agreement. Any disputes arising under this Agreement will be resolved amicably by the two Governments.

ARTICLE IX

    The undertakings of each Government under this Agreement are subject to the availability of funds and to the applicable laws of their respective countries.

ARTICLE X

     This agreement shall enter into force on the date of signature and shall remain in force until ninety days after the date of written notification from either Government to the other of intent to terminate it. 

    Done at Washington, D.C. on September 27, 1990 in two original copies, each in the Bulgarian and the English languages, both texts being equally authentic.
