Physical Presence in United States

Write actual physical presence in the United States prior to the child’s birth in exact detail.  Vacation trips abroad, schooling in foreign countries, and any other brief absences cannot be counted as physical presence in the United States.  (See 7 FAM 1130).  When doubt exists that the parent’s physical presence in the United States is sufficient to transmit citizenship, documentary evidence of the claimed physical presence is required.  Such documentary evidence can include items such as pay slips, work or rental contracts, school records, receipts and other items that prove that the transacting party was physically present in the United States to carry out the activity.
